< ARTICLE 1: APPLICABILITY >
The site https://hairborist.com is published by the public limited company Hairborist BVBA, of which the registered office is located at Kapellestraat 40, B-8720 Wakken (Belgium) and which is registered at the Crossroads Bank for Enterprises under the number BE0898695003. The site is hosted by HAIRBORIST BVBA.
These terms and conditions of sale apply to all products, gift cards and promotional offers from HAIRBORIST BVBA.
Each order with one or more products or a gift card implies knowledge and acceptance of these general terms and conditions at the exclusion of any other terms and conditions. Any derogation of these terms and conditions is only declared applicable after written authorization from HAIRBORIST BVBA, in which the other terms and conditions continue to apply.
HAIRBORIST BVBA reserves the right to change these terms and conditions of sale at any time and without preliminary information. However, the changes are not applicable to the previously accepted and confirmed reservations and orders of the customer.
< ARTICLE 2: PRODUCTS AND ORDERS >
All products, gift cards and promotional offers from HAIRBORIST BVBA are described as completely and as accurately as possible on the Internet site https://hairborist.com
The photos, graphic design and description of the products offered for sale are provided for indicative purposes only and do not constitute a commitment on the part of HAIRBORIST BVBA.
The promotional offers are only valid as long as the offers last and as long as the stock lasts.
The products are meant for personal use by the customer and have no direct connection with his/her professional activities. Retailers who are interested in the products distributed by HAIRBORIST BVBA can get in touch via email at [email protected]
If the customer wishes to place an order, he/she chooses the different products in which he/she is interested. The customer must tick the checkbox next to the text “I unconditionally accept the general terms and conditions” for validation before choosing the proposed payment method on the same page.
For each order placed on https://hairborist.com there will be a written confirmation sent via email, fax or post with the order attribute and the exact amount invoiced as well as the delivery methods.
If HAIRBORIST BVBA has not sent any confirmation, the purchase is not deemed definite.
HAIRBORIST BVBA reserves the right to cancel each order for legitimate reasons.
When placing an order, all the required information must be provided to HAIRBORIST BVBA.
The customer can request a free invoice if he/she provided his/her personal details or the full details of his/her company. If the information provided contains errors that create additional costs for HAIRBORIST BVBA, these costs can be charged to the customer.
The validation of the purchase order contains an electronic signature, which the parties deem to be of the same value as a handwritten signature.
If the products or services ordered are no longer available, HAIRBORIST BVBA will inform the customer as soon as possible and will offer the customer the chance to cancel the order free of charge. An order placed via the site can be canceled by contacting customer service are +32.56.61.06.79, subject to article 7 of these general terms and conditions.
< ARTICLE 3: GIFT CARDS >
A gift card can never wholly or partly be exchanged for money; is the sole responsibility of the bearer, primarily in case of loss or theft; and must be used during the period of validity. After the expiry date, the gift card cannot be reimbursed or used in any other way, nor can it be altered or exchanged against any other services.
< ARTICLE 4: PAYMENT >
Orders are paid beforehand (with Visa, Mastercard, Bancontact/Mister Cash, American Express and other payment methods provided on this shop).
HAIRBORIST BVBA reserves the right to suspend or cancel the order in the event of non-payment of the amount owed by the customer.
Delivery of each new order can be suspended in the event of late payment of a previous order, irrespective of the provisions of these terms and conditions.
< ARTICLE 5: PRICE >
The prices are indicated in euro excluding VAT and may vary over the course of the year. The products are invoiced at the price applicable at the time of order. This does not include the shipping costs, which are invoiced on top of the price of the products purchased and depending on the price of the order. The shipping costs are specified before the order is registered by the customer.
< ARTICLE 6: DELIVERY >
The products are delivered by courier service to the address provided by the customer on the purchase order.
Delivery takes place on average within 3 to 5 days from the receipt of the purchase order and according to the chosen delivery method. The delivery times serve as an indication. Potential delays can in no way result in an award of damages on the part of HAIRBORIST BVBA.
Any custom taxes owed, namely import charges or excise duties, will in all cases be charged to the addressee and can in no way constitute a reason for reclamation or damages from HAIRBORIST BVBA.
In the event of the absence or fruitless deliveries, the package will be taken to a depository for a certain period of time. If the customer fails to collect the package at this depository within the prescribed period, the delivery will be sent back to HAIRBORIST BVBA. If the customer so wishes, the order can be delivered again but only after payment of the extra shipping costs.
By way of derogation of Article 1583 of the Belgian Civil Code, HAIRBORIST BVBA will retain ownership of the purchased products until the price in principal and any delay interests or damages has been paid in full.
< ARTICLE 7: CONSUMER RIGHTS >
Each consumer has the right to cancel a purchase and receive a reimbursement within 7 business days after purchase without giving a reason. This only applies to orders on the site (e-commerce).
In order to exercise this right, the customer must comply with the following conditions and instructions:
The products must be returned in perfect condition, in their original state (packaging intact and unopened, with accessories, package insert, etc.) together with the invoice. Returns that do not comply with the aforementioned will not be accepted.
HAIRBORIST BVBA accepts the return shipment if it is returned to HAIRBORIST BVBA within a period of 14 business days after the date of receipt and if the customer has filled in the ‘Returns’ form.
The shipment must be sent to the following address: HAIRBORIST BVBA return e-commerce, Kapellestraat 40, B-8720 Wakken (Belgium).
The delivery charges of the return shipment are at the expense of the buyer unless the product is non-compliant or there is an error with the delivery references. In that case, the return costs will be reimbursed by HAIRBORIST BVBA.
If the customer chooses to use this option, he/she will ship the goods in their original state and at his/her own risk back to HAIRBORIST BVBA for reimbursement.
In the event of failure to comply with the procedures and specified time limits, the customer cannot call on non-conformity or defects of the products delivered given that the products are then deemed to be in conform and without defects.
< ARTICLE 8: PRIVACY >
HAIRBORIST BVBA respects the right to privacy and processes the customer’s personal information with utmost care. This information is used in order to offer the customer the best possible service, to process the orders optimally, and if necessary to keep the customer informed about interesting offers and news by means of an email-sent newsletter. The customer’s personal information will not be provided or sold to third parties in any event.
The customer can consult his/her personal information in the HAIRBORIST BVBA files at any time. If he/she wishes to delete this information from the HAIRBORIST BVBA files, he/she can inform the company via email or post.
< ARTICLE 9: RESPONSIBILITY >
HAIRBORIST BVBA rejects any responsibility in relation to damages, in the broadest sense of the word, except if these damages are due to serious error or willful misconduct on the part of HAIRBORIST BVBA.
In the event of a misunderstanding or delay due to the use of the Internet or any other mode of communication in correspondence with the customer, HAIRBORIST BVBA cannot be held responsible, except in the event of willful misconduct or a serious error on the part of HAIRBORIST BVBA.
HAIRBORIST BVBA cannot be held responsible for indirect damage that may result from the purchase of these products.
HAIRBORIST BVBA disclaims all liability for any interruption of the website or any occurrence of bugs and/or any inaccuracy or incompleteness of the information available on this site.
HAIRBORIST BVBA cannot be held responsible in the event of allergies or the incorrect use of the products.
< ARTICLE 10: APPLICABLE LAW AND DISPUTES >
Disputes relating to the conclusion, validity, interpretation or implementation of this agreement are exclusively governed by Belgian law.
In the event of disputes, only the courts and tribunals of the registered office of HAIRBORIST BVBA are competent (RLP Gent, department Kortrijk).
